These Terms and Conditions ("Terms") govern your use of our website www.booknaija247.com and mobile application (collectively referred to as the "Platform"), including all related services and content offered by BookNaija247 (“we,” “us,” or “our”).
By accessing or using the Platform, whether as a guest, host, agent, or visitor, you agree to be bound by these Terms. If you do not agree, you may not use the Platform.
1. Definitions
- User: Any individual or entity accessing the Platform, including Guests, Hosts, and Agents.
- Guest: A user who books or browses accommodations.
- Host: A user who lists properties for rent.
- Agent: A user who refers or facilitates bookings on behalf of Guests or Hosts.
- Content: Any text, photos, video, or materials submitted by users or provided by BookNaija247.
2. Eligibility
You must be at least 18 years old and capable of entering into a legally binding contract to use our Platform. By using the Platform, you represent and warrant that you meet these requirements.
3. Account Registration
To access certain features, users must register an account by providing accurate, current, and complete information. Users are responsible for maintaining the confidentiality of their credentials and for all activities that occur under their account.
We reserve the right to suspend or terminate any account found to be violating our Terms or engaging in fraudulent activity.
4. Services Overview
BookNaija247 provides an online marketplace connecting Guests with Hosts offering short-term accommodations. Services include:
- Booking accommodations
- Listing and managing properties
- Processing secure payments
- Communication between users
- Customer support and dispute mediation
We do not own or manage listed properties. All transactions and agreements are made between the Guest and the Host.
5. Host Obligations
Hosts agree to:
- Accurately describe listings, pricing, amenities, and availability
- Provide a clean, safe, and functional space as listed
- Accept and honor confirmed bookings
- Comply with all local laws, safety, tax, and zoning requirements
- Respond promptly to Guest inquiries and complaints
Hosts will only receive payment from BookNaija247 after the Guest has successfully checked into the property. Bookings must be confirmed through our platform, and Guest payments are processed and held until check-in is verified.
BookNaija247 reserves the right to deactivate or remove any listing that violates these Terms or presents a risk to Guests.
6. Guest Obligations
Guests agree to:
- Provide accurate booking information
- Respect check-in/out times, house rules, and the Host’s property
- Avoid illegal activities, damages, or misconduct during their stay
- Pay all charges and fees in full, including any damage claims if applicable
Guests are required to make payment on the BookNaija247 platform. Bookings are only confirmed after payment has been verified. Guests are solely responsible for their conduct and any guests accompanying them during their stay.
7. Agent/Referral Terms (if applicable)
Agents who refer Guests or Hosts must:
- Use authorized and ethical marketing practices
- Not misrepresent BookNaija247 or any listing
- Only receive commissions as agreed in writing
Agents will only receive agreed commissions after the Guest has checked into the Host property, and payment has been verified by BookNaija247.
BookNaija247 may suspend agent accounts for abuse, fraud, or non-compliance.
8. Payments and Fees
We use secure third-party payment processors (e.g., Paystack, Flutterwave) to collect payments. Guests agree to pay all booking fees, taxes, and charges applicable to their reservation. Hosts authorize BookNaija247 to collect payment on their behalf and disburse payouts minus applicable service fees.
All pricing and payment terms are stated in Nigerian Naira (₦), unless otherwise indicated.
9. Cancellations and Refunds
A. Guest Cancellation Policy
- If the guest cancels 7 days or more before check-in, only 50% of the total amount paid will be refunded. This excludes the non-refundable service charge.
- If the guest cancels less than 7 days before check-in, no refund will be issued.
- All cancellations must be submitted in writing to support@booknaija247.com.
- Service fees are non-refundable once a booking is confirmed.
- If the guest fails to show up (no-show), no refund will be processed.
Note: Verified emergency cases (such as natural disasters or government-imposed travel restrictions) may be considered for partial refunds at the sole discretion of BookNaija247.
B. Host Cancellation Policy
- If a host cancels more than 7 days before check-in, a penalty fee of ₦10,000 will be deducted from their next payout.
- If a host cancels within 7 days of check-in, a penalty fee of ₦25,000 will be charged, and the listing may be downgraded in visibility.
- Cancellations after guest check-in are strictly prohibited, except in verified emergencies or safety concerns.
Frequent cancellations by a host may lead to temporary suspension or permanent removal.
C. Agent Cancellation Responsibility
- Losing their commission for the cancelled transaction
- Having their agent/referral account suspended
- Being held liable for losses incurred by the platform or affected users
D. Platform-Initiated Cancellations
BookNaija247 reserves the right to cancel bookings if:
- Fraudulent or suspicious activity is detected
- Any party violates the platform’s terms
- There are confirmed health or safety concerns
Refunds in such cases will be processed at the discretion of BookNaija247.
E. Refund Timeline
Approved refunds will be processed within 7 to 10 business days to the original payment method used. Note that transaction and processing charges are non-refundable.
10. User Conduct
Users may not:
- Use the Platform for any unlawful or fraudulent purpose
- Post misleading, false, or offensive content
- Infringe upon the rights of others
- Attempt to hack, disrupt, or reverse-engineer the Platform
- Bypass any security or access controls
We reserve the right to ban, suspend, or remove any user who violates these Terms.
11. Intellectual Property
All content, branding, software, and materials on the Platform are the exclusive property of BookNaija247 or its licensors. You may not copy, reproduce, distribute, or exploit any portion of the Platform without our written permission.
12. Limitation of Liability
BookNaija247 acts only as a platform facilitator and is not a party to rental agreements between Guests and Hosts. We are not liable for:
- Any loss, theft, damage, or injury occurring at a listed property
- Inaccurate listings or false representations by Hosts or Guests
- Technical issues, interruptions, or third-party service failures
- Any indirect, incidental, or consequential damages
Use of the Platform is at your own risk.
13. Indemnification
You agree to defend, indemnify, and hold harmless BookNaija247, its directors, staff, and affiliates from any claims, liabilities, losses, or damages arising from your use of the Platform or breach of these Terms.
14. Privacy
Your use of the Platform is also governed by our Privacy Policy, which outlines how we collect, use, and protect your personal data.
15. Modifications to Terms
We may update or change these Terms from time to time. Continued use of the Platform after changes are posted constitutes your acceptance of the new Terms.
16. Governing Law and Jurisdiction
These Terms are governed by the laws of the Federal Republic of Nigeria. Any dispute arising from or relating to these Terms shall be resolved in the courts of competent jurisdiction in Lagos State, Nigeria.
